Terms of Service

Acceptance

These Terms of Service ("Terms") form a binding agreement between you and Mohamed Rayene Romdhane ("we", "us", "our"), operator of the Chkobba Café website at chkobagame.xyz (the "Service"). By accessing or using the Service you agree to these Terms and to our Privacy Policy and Cookie Policy. If you do not agree, do not use the Service.

The service

The Service is a free, browser-based, four-player (2-vs-2) implementation of the Tunisian card game chkobba. We provide it on a best-effort basis and may change features, add bot players, or take it offline at any time without notice.

Eligibility & age

You must be at least 13 years old to use the Service (or older where local law sets a higher minimum digital-consent age — for example 16 in some EU member states). By using the Service you confirm that you meet this requirement.

Account-less play

The Service does not require an account, an email, or a password. The "profile" you set (nickname and avatar) is stored locally in your browser and is shared only with the players in your room and our server while a match is in progress.

Acceptable use

You agree not to:

Cheat, exploit bugs, or use bots, automation, or modified clients to gain an unfair advantage.
Harass, threaten, defame, or use slurs against other players via nicknames, avatars, or any chat feature.
Attempt to gain unauthorised access to our servers, other players' devices, or any account.
Use the Service to distribute malware, conduct phishing, or otherwise harm others.
Disrupt the Service through denial-of-service, abusive request volume, or interfering with rate-limiting.
Reverse-engineer, decompile, or scrape the Service except to the extent permitted by mandatory law.
Use the Service to run any commercial activity, public tournament with prizes, or paid match without our written permission.

We may suspend or block any IP, room, or device that violates these rules.

No gambling

Chkobba Café is a skill-and-luck card game played for entertainment. There is no real-money wagering, no virtual currency redeemable for cash or cash-equivalent, no in-game purchases, no prize draws, and no leaderboards tied to rewards. You agree not to use the Service to organise, advertise, or facilitate any form of gambling activity.

User-generated content

The only user content the Service stores is the nickname you choose. By choosing a nickname you grant us a worldwide, non-exclusive, royalty-free licence to display it to other players in your room and to keep it in temporary server memory while a match is in progress. Do not choose a nickname that infringes someone else's rights, contains slurs, or impersonates a real person without consent.

Intellectual property

The Service — including the visual design, code, illustrations, sound effects, and the name "Chkobba Café" — is owned by us or our licensors and is protected by copyright and other intellectual-property laws. The card game chkobba itself is a public-domain traditional game; only our specific implementation is protected. You may not copy, modify, distribute, or create derivative works of our materials without permission, except for temporary in-browser use needed to play the Service.

DMCA / copyright complaints

If you believe content on the Service infringes your copyright, send a notice to privacy@chkobagame.xyz with subject "DMCA" including: identification of the copyrighted work, the URL of the infringing material, your contact information, a good-faith statement, a statement of accuracy under penalty of perjury, and your physical or electronic signature. We will respond to valid notices in accordance with applicable law.

Advertising

The Service is funded by Google AdSense advertising. By using the Service you acknowledge that ads may appear and that ad personalization depends on the consent decision you make in our consent dialog. See the Privacy Policy and the Cookie Policy for details. We don't control the specific ads shown — that is determined by Google's ad inventory and your consent state.

Availability & changes

The Service is provided "as available". We may change, suspend, or discontinue features, maintenance windows, server regions, or the entire Service at any time without notice. We may modify these Terms; material changes will be flagged on the homepage for at least 14 days. Continued use after the change is acceptance of the new Terms.

Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranty of any kind — express, implied, or statutory — including without limitation merchantability, fitness for a particular purpose, non-infringement, accuracy, uptime, or fitness for any specific use case. We do not warrant that the Service will be error-free, uninterrupted, or free of harmful components.

Some jurisdictions do not allow the exclusion of certain warranties; in those, the exclusions above apply only to the extent permitted by law.

Limitation of liability

To the maximum extent permitted by law, in no event will we, our affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with the Service.

Our total cumulative liability for any claim related to the Service will not exceed €50, regardless of cause of action.

Nothing in these Terms limits liability that cannot be limited under mandatory law, including liability for fraud, gross negligence, willful misconduct, death or personal injury caused by negligence, or — for EEA / UK consumers — your statutory consumer rights.

Indemnity

You agree to indemnify and hold us harmless from any claim, loss, liability, or expense (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or your infringement of any third-party right. This indemnity does not apply where prohibited by law (notably for consumers in the EEA and UK acting outside their trade or profession).

Termination

You may stop using the Service at any time. We may suspend or terminate your access for any reason — for example, breach of these Terms or risk to other players. Provisions that by their nature should survive termination (intellectual property, disclaimers, liability, governing law) will survive.

Governing law & venue

These Terms are governed by the laws of France, European Union, without regard to conflict-of-law rules. Subject to the dispute resolution section below, the competent courts of France have exclusive jurisdiction.

If you are a consumer resident in the EEA or the UK, this clause does not deprive you of the protection of mandatory rules of your country of residence, including the right to bring proceedings in your local courts.

Dispute resolution

Before filing a claim, please contact us at support@chkobagame.xyz so we can try to resolve the issue informally. EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr. We are not obliged to take part in alternative dispute-resolution procedures, but we are willing to consider doing so on a case-by-case basis.

Miscellaneous

Entire agreement. These Terms, the Privacy Policy, and the Cookie Policy form the entire agreement.
Severability. If any clause is unenforceable, the rest remain in effect.
No waiver. Our not enforcing a clause is not a waiver of it.
Assignment. You may not assign these Terms. We may assign them to an affiliate or to a successor in connection with a merger, acquisition, or sale of assets.
Force majeure. We are not liable for delays caused by events beyond our reasonable control.
Headings are for convenience only.
